The Brand Image Promotion Unit (LMIH) within the Ministry of the Economy (MECO) collects and processes personal data about you ("data") in the context of the performance of its public interest missions and its legal obligations. 2. Categories of data, legal basis and purposes of processing
The lawfulness of the data processing carried out
The MECO/LMIH processes your data for the purpose of fulfilling its public interest missions and legal obligations under the applicable data processing legislation, in particular the lawfulness grounds of Article 6 of the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (Regulation (EU) 2016/679). Without prejudice to the application of the other bases of lawfulness mentioned above, the MECO/LMIH carries out the data processing for which you have given your consent. Please note that you have the right to withdraw your consent at any time (without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal of consent). To exercise your right to withdraw your consent, please contact our Data Protection Officer, specifying the processing for which you wish to withdraw your consent.
Categories of data processed
The MECO/LMIH processes the following categories of data :
- last name;
- first name;
- company;
- structure;
- email address;
- phone number.
The purposes of the processing
The purposes of the processing for which your data are intended are the following :
- Downloading toolbox items
- Downloading graphic elements
- To respond to the contact form
3. Data sources and their recipients
The data processed by the MECO/LMIH comes from the following sources :
- Toolbox download form
- Contact form
In order to carry out its public interest missions and legal obligations, the MECO/LMIH transmits your data, including by direct access, to the following categories of recipients :
- Binsfeld, 14 rue du Parc, Luxembourg, website management.
- Luxhosting Networks S.à r.l., Luxembourg, hosting of the website.
4. Collection of data from the data subject : mandatory nature of the data provision and the consequences of refusing to provide it
The provision of the data by you to the MECO/LMIH is mandatory (in accordance with the applicable legislation, respectively by decision of the MECO/LMIH). A refusal on your part to provide us with the requested data leads to :
- in the context of downloading elements from the toolbox: it will not be possible to receive the download link;
- in the context of downloading elements from the toolbox: it will not be possible to receive the download link;
- in the context of the contact form: it will not be possible to answer you;
5. Retention period
Your data is kept at in a form that allows you to be identified for the following maximum periods:
- in the context of downloading graphic elements: 1 year from receipt of the download form;
- in the context of downloading toolbox items: 1 year from receipt of the download form;
- in the context of the contact form: 3 months from the receipt of the request;
The above retention periods apply without prejudice to possible further processing for compatible purposes, in particular for statistical or scientific research purposes or for archival purposes in the public interest (in particular their retention by the National Archives) or for the purposes of ongoing legal proceedings.
6. The transfer of your data to a third country
Your data will in principle be processed within the European Economic Area. The MECO/LMIH may, however, transfer your data to a third country (i.e. one that is not part of the European Economic Area). Data transfers are carried out in accordance with the conditions set out in Chapter V of Regulation (EU) 2016/679. More information about possible international transfers of your data can be obtained from our Data Protection Officer.
7. The rights of the data subject
You have the rights provided by the provisions of Chapter III (Articles 12 to 22) of Regulation (EU) 2016/679. You may thus, within the limits of the applicable legislation, access and obtain a copy of the data concerning you (Article 15), obtain the rectification of inaccurate or incomplete data (Article 16) and obtain the deletion of such data under the conditions provided for in Article 17 of the said Regulation.
You also have, within the limits of the applicable legislation, the right to object to the processing of your data under the conditions set out in Article 21 of Regulation (EU) 2016/679.
In certain cases, you also have the right to limit the processing of your data (Article 18) and to portability (Article 20).
- The processing of your data does not involve any automated decision making that produces legal effects on you or significantly affects you in a similar way.
Any communication relating to a request for information, concerning a complaint or regarding the exercise of your rights under the provisions of Regulation (EU) 2016/679 should be addressed to the MECO/LMIH's Data Protection Officer.
8. Complaint to the National Commission for Data Protection (CNPD)
If, after having contacted us, you believe that the processing of your data by the MECO/LMIH constitutes a breach of Regulation (EU) 2016/679 or that your rights under the said Regulation have not been respected, you may lodge a complaint with a supervisory authority in the field of data protection, namely in Luxembourg the Commission Nationale pour la Protection des Données (CNPD)(https://cnpd.public.lu ; 15, Boulevard du Jazz, L-4370 Belvaux ; Tel: (+352) 26 10 60-1).
